A different regime
If the country seeking your loved one is Malaysia or Brunei, most of what is written elsewhere on this site does not apply.
Singapore’s arrangements with both countries operate through reciprocal endorsement of warrants. A Malaysian or Bruneian warrant is backed for execution here, rather than a fresh extradition process being started. Two mechanisms exist: Part 6 of the Extradition Act, which applies to Malaysia, and section 121 of the Criminal Procedure Code, which applies to both.
What is different
The central question is different. In an ordinary extradition, a Magistrate asks whether there is a case fit to be tried. On this track the core inquiry is directed to identity — whether the person before the court is the person named in the warrant.
The time limits are different. Remand still runs in cycles of not more than seven days, but the outer periods are shorter: discharge follows after one month in custody absent reasonable cause, and a separate review is triggered three months after a surrender order.
Grounds equivalent to the unjust or oppressive test are available, and on this track they are directed to the court rather than only to the Minister.
Why it matters
Because the process is faster and narrower, the window for taking advice is shorter. Families who read the general extradition pages and assume they have weeks to consider their position are working from the wrong timetable.
